These Terms of Service ("Terms") govern your access to and use of the AmenityFit platform, including the web application at amenityfit.app and the resident-facing fitness application (collectively, the "Service"), operated by Fitmakesenz LLC ("AmenityFit," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years of age to use the Service. By using the Service, you represent that you meet this age requirement. The Service is intended for residents of buildings that have an active AmenityFit subscription through their building management.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access to your account. We reserve the right to terminate accounts that violate these Terms.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
The Service provides fitness programming, nutritional guidance, and coaching information for general wellness purposes. The content provided through the Service, including programs generated by the platform and responses from the Fitness Assistant, is not medical advice and is not a substitute for professional medical advice, diagnosis, or treatment.
Before beginning any new fitness program, consult your physician or qualified healthcare provider, particularly if you have a pre-existing medical condition, injury, or health concern. You assume full responsibility for your use of the fitness programs and any resulting physical activity.
AmenityFit is not a healthcare provider and is not subject to HIPAA. The platform is a fitness and wellness application.
The Service, including all content, features, programs, and functionality, is owned by Fitmakesenz LLC and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in connection with your building's amenity program. You may not reproduce, distribute, modify, or create derivative works of any Service content without our express written permission.
If you are a building manager, property management company, or building owner accessing the Service under a building subscription, your use is additionally governed by the service agreement executed between your organization and Fitmakesenz LLC. In the event of any conflict between these Terms and that agreement, the service agreement controls.
The Service integrates with third-party services including wearable device platforms (Whoop, Apple, Fitbit), video delivery (Vimeo), image delivery (Cloudinary), and data infrastructure (Google Firebase). Your use of those integrations is subject to the respective third-party terms of service and privacy policies. We are not responsible for the practices of third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, AMENITYFIT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FITMAKESENZ LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, OR LOSS OF REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
You agree to indemnify and hold harmless Fitmakesenz LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New York County, New York.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the effective date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
